Privacy policy
Protecting your data matters to me. This policy explains which personal data I process, why, with whom I share it and what your rights are. It applies to the website www.kocharianphotography.com and to my photography services. It is based on the Swiss Federal Act on Data Protection (FADP) and, where applicable, on the EU General Data Protection Regulation (GDPR).
1. Controller
Kocharian Photography, Israel Kocharian, Chemin de Bérée 12B, 1010 Lausanne, Switzerland. For any question about your data: kocharian.photography@gmail.com or +41 76 468 77 60.
2. Data I process
Browsing: when you visit the website, your IP address, the date and time, the pages viewed, your browser, your device and the referring page are processed automatically.
Quote requests and contact: through the form, I receive the information you enter, namely your name, email, phone number, type of session, budget, date and place of the event, number of guests and your message. The same applies if you write to me by email, call me or contact me on social media.
Services: if you book, I process the data needed for the contract, namely your identity, contact details, the delivery address for the USB stick, information about the event, billing and payment data, and our correspondence.
Photos and videos: the images I take show you and your guests. Some may indirectly reveal sensitive information, for example a religious ceremony; they are processed only for the service, with the greatest care.
Private galleries: your wedding photos are put online in a gallery protected by an access code, which you share with your guests yourself.
Reviews: a review left on Google is public and subject to Google's rules. The website displays Google reviews that have already been published (first names and text) and their average rating.
3. Why I process your data
to answer your requests and prepare a quote;
to conclude and perform the contract: preparation, photo shoot, editing and delivery of the photos;
to invoice and comply with my legal obligations, in particular accounting obligations;
to ask you, after your gallery has been delivered, for a review of my service, which you may decline at any time;
to run the website, keep it secure and measure its traffic;
to show my work on my website, social media and Google profile, only with your consent (see section 5).
4. Recipients and service providers
I do not sell or rent your data. I only share it with the service providers I need, who process it on my behalf:
Wix.com Ltd. (Israel): website hosting, forms, contact management, sending emails, private galleries and statistics, together with its technical subcontractors (hosting, security and bot protection, error monitoring);
Google (Google Ireland Ltd. and Google LLC): email, fonts, business profile and reviews;
where applicable, Swiss Post or a delivery service, to send your USB stick;
where needed, a fiduciary for the accounting, and the authorities where required by law.
5. Publication of photos
Your photos are yours first. I only publish images of you or your loved ones on my website, social media or Google profile with your consent, normally given when you book. You may withdraw this consent at any time, without giving a reason: I will then remove the images concerned from my channels, as far as technically possible (copies already shared by others are beyond my control). Anyone photographed, for example a guest, may also ask me not to publish an image in which they appear.
6. Disclosure abroad
My service providers may process data outside Switzerland, in particular in the European Union, Israel and the United States. The Swiss Federal Council recognises the European Union and Israel as providing an adequate level of protection. For the United States, transfers are based on the providers' certification under the Swiss-U.S. Data Privacy Framework or on standard contractual clauses recognised by the Federal Data Protection and Information Commissioner (FDPIC).
7. Cookies
The website uses cookies, small files stored by your browser:
Necessary cookies (Wix): operation of the website, security and bot protection, for example XSRF-TOKEN, hs, bSession, svSession and __cf_bm. They expire at the end of the session or are kept for up to two years.
Statistics (Wix): measuring the website's traffic and performance.
You can refuse or delete cookies in your browser settings. Without the necessary cookies, some features of the website may no longer work.
8. Retention period
requests that do not lead to a booking: as long as needed to answer and follow up, then no more than two years after our last exchange;
contracts, invoices and accounting records: ten years, as required by law (art. 958f of the Swiss Code of Obligations);
private galleries: three months online, then removed;
backup copy of your photos: kept so that I can send them again if you lose them; you may ask for its deletion at any time;
browsing data and cookies: for the periods given in section 7.
9. Security
I take appropriate technical and organisational measures to protect your data: encrypted connection (HTTPS), protected accounts that only I can access, galleries protected by a code. As no transmission over the Internet is completely secure, I recommend that you do not send sensitive information through the form.
10. Your rights
You may at any time:
find out whether I process data about you and obtain a copy (right of access);
have inaccurate data corrected;
ask for your data to be deleted or object to its processing;
withdraw your consent, for the future;
receive the data you provided to me in a common format (data portability).
To exercise these rights, write to me at kocharian.photography@gmail.com; I may ask you for proof of identity. I will normally reply within 30 days. Some data must however be kept to comply with a legal obligation, for example for accounting. If you believe your rights are not being respected, you may contact the Federal Data Protection and Information Commissioner (FDPIC), Feldeggweg 1, 3003 Bern, www.edoeb.admin.ch.
11. Visitors from the European Union
Where the GDPR applies, my processing is based on the performance of a contract or pre-contractual steps (quote, booking, service), on compliance with legal obligations (accounting), on my legitimate interests (website security and statistics, follow-up of our relationship, review requests) and on your consent (publication of photos). You also have the right to restriction of processing and the right to lodge a complaint with the data protection authority of your country of residence.
12. Social media and external links
The website contains simple links to Instagram and Facebook (Meta): no plug-in from these networks is embedded, and no data is sent to them unless you click. On these platforms, as on Google, their own privacy policies apply.
13. Automated decisions
I do not take any decision based solely on the automated processing of your data.
14. Changes
I may update this policy, for example if my service providers or the law change. The version published on this page applies. This English version is a translation: in case of discrepancy, the French version prevails.
